A recent prosecution by South Holland District Council highlights the increasing focus local authorities are placing on enforcing housing standards in the private rented sector.
Sharing details of the case on LinkedIn, South Holland District Council reported that a private landlord was successfully prosecuted after failing to comply with an Improvement Notice served following an inspection of a rental property in Long Sutton.
The inspection identified a number of serious hazards under the Housing Health and Safety Rating System (HHSRS), including both Category 1 and Category 2 hazards relating to excess cold, unsafe stairs, fire safety, and damp and mould.
The council required the landlord to carry out remedial works within a specified timescale. Although the tenant later moved out of the property, the legal requirement to comply with the Improvement Notice remained.
Following the expiry of the notice, the council made several attempts to inspect the property and assess whether the required works had been completed. After access was repeatedly refused, officers obtained a Warrant of Entry through the courts. Upon entering the property, they found that none of the required works had been carried out.
Legal proceedings followed under the Housing Act 2004. On 27 July 2026, the landlord was convicted of failing to comply with the Improvement Notice and ordered to pay a total of £6,408, comprising a fine, victim surcharge and prosecution costs.
While every enforcement case is different, this prosecution reflects a wider trend of local authorities taking a more proactive approach to housing standards. As councils continue to make greater use of their enforcement powers, landlords should expect increased scrutiny where serious hazards are identified or statutory notices are not complied with.
The case also serves as a reminder that an Improvement Notice does not cease to apply simply because a tenant has moved out. Unless a local authority formally withdraws or varies the notice, landlords remain legally responsible for completing the required works within the specified timescales.
