The Housing Bill was published this week and includes further measures intended to tackle rogue landlords and letting agents. ‘Highlights’ include: banning orders for rogue landlords and letting agents; a database of rogue landlords and letting agents; extension of rent repayment orders; greater data sharing (eg councils can access tenancy deposit scheme info); civil penalty scheme; a tougher fit and proper person test; and new abandonment process. It also makes clear that councils can use data collected for council tax registration for enforcement purposes.

Important changes affecting landlords are coming into force on 1st October 2015 as a result of The Deregulation Act. The main changes are to the rules governing a notice to quit under Section 21 of the Housing Act 1988. The changes come into force on October 1 and apply to tenancies entered into on or after that date.

A tribunal has supported Liverpool City Council’s bid to require a landlord to install affordable heating because his tenants were likely to be on low income. The case has been labelled ‘significant’ by the authority and could lead the way for EHOs across the country to demand that landlords replace inadequate and expensive heating systems if their tenants cannot afford to properly heat their home.

Concerns are rising that the imminent roll-out of Right to Rent has been badly thought out on grounds too numerous to mention. No firm date has yet been announced, but it is thought it could be as early as October. The Home Office may clarify it this week.
